Your child is not yet a U.S. citizen, so he/she will need a travel document or passport from Germany. Both adoptions to the United States from Germany and from the United States to Germany are possible. Monitor local media for breaking events and adjust your plans based on new information. Be aware of your surroundings when traveling to tourist locations and crowded public venues.
The facility must not restrain residents for purposes of discipline or convenience unless required to treat the residents' medical symptoms. The facility must establish a mechanism for residents to voice complaints or grievances and have a responsive system through which it can respond promptly. The facility must ensure each resident's personal privacy and confidentiality, as related to the telephone, mail, visitation, and clinical records.
Nursing Home Complaint Investigations
A resident at high risk for pressure sores receives appropriate preventative care. Residents with pressure sores receive the proper treatment, including nutrition, turning, positioning, etc., to facilitate healing. Each resident receives the necessary care and services to maintain or, when possible, improve his or her functional ability. Certified copies of the Report of Death will be sent to the next-of-kin or legal representative and the original will be sent to the Department of State for permanent filing. In addition, if you feel the quality of care provided at any facility has been poor, you may register a complaint with yourLong Term Care Ombudsman andState Survey Agency for investigation.

Germany is a party to theHague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption. Read the Department of State’s COVID-19 page before planning any international travel, and read the Embassy COVID-19 page for country-specific COVID-19 information. Up to 20 copies of the Report of Death, issued at the time of death, will be provided by the embassy or consulate free of charge. If additional copies are needed in the future, they can be obtained for a fee from the Department of State. All travelers should familiarize themselves with conditions at their destination that could affect their health (high altitude or pollution, types of medical facilities, required immunizations, availability of required pharmaceuticals, etc.). The survey protocols and interpretive guidelines serve to clarify and/or explain the intent of the regulations.
Nursing homes vary from institutional settings to more homelike residences. Nursing homes may stand alone, be integrated or near assisted living facilities, or may exist as a component of continuing care retirement communities. The living space may include private or semiprivate rooms shared with a roommate. Strict safety regulations are adhered to within these facilities to accommodate the physical and mental weaknesses of their residents. For help with an ongoing physical or mental health condition or memory loss, long-stay nursing home care may be the right choice. All long-stay nursing home care provides 24-hour supervision, three meals a day, and assistance with everyday activities, with additional services as needed.
Plan of Care
Correction dates in some instances may not be available for more recent surveys that have not fully concluded. A Plan of Correction is required by the Nursing Home Administrator to demonstrate how the facility will correct any deficiencies cited within the facility. Each nursing home is required to post their plan of correction, statement of deficiencies, and any enforcement actions taken against their facility in a place readily accessible to residents and designated representatives without staffing assistance. The referral is a proposed match between you and a specific child based on a review of your dossier and the needs of the child. The adoption authority in Germany will provide a background study and other information, if available, about the child to help you decide whether to accept the referral or not.

When traveling during the adoption process, we encourage you to enroll with the Department of State through our Smart Traveler Enrollment Program to receive important information from the Embassy about safety conditions in your destination country. Whether there is a family emergency in the United States or a crisis in Germany, enrollment assists the U.S. Many residents pay for the care out of their own private funds but some have assistance from long term care insurance policies. Still others may receive help with costs from state Medicaid programs when their finances are depleted.
All complaint and incidents received about nursing homes are reviewed by the Department through the Centralized Complaint Intake Unit with appropriate action taken. The most serious complaints and incidents require Department investigators to conduct interviews, review medical records and other facility documentation, and perform other activities onsite at the nursing home. If you have concerns about your adoption process, we ask that you share this information with the Consulate in Frankfurt, particularly if it involves possible fraud or misconduct specific to your child’s case. The Department of State takes all allegations of fraud or misconduct seriously. A .gov website belongs to an official government organization in the United States. The facility must meet the applicable provisions of theLife Safety Code of the National Fire Protection Association. The facility must employ a dietitian and sufficient support personnel competent to carry out the functions of the dietary service. Each resident's medications are carefully administered to prevent the occurrence of medication errors. Each resident receives sufficient fluid intake to maintain proper hydration.
Improper payments may have the appearance of buying a child, violate applicable law, and could put all future adoptions in Germany at risk. The Foreign Corrupt Practices Act, for instance, makes it unlawful to bribe foreign government officials to obtain or retain business. Further, the IAA makes it unlawful to improperly influence relinquishment of parental rights, parental consent relating to adoption of a child, or a decision by an entity performing Central Authority functions. The Department conducts Certification Surveys, with the time between surveys ranging from 9 months to 15 months at each nursing home.
Resident rooms must provide residents with appropriate private space for clothes and other personal belongings. The facility, when authorized by the resident, must safeguard and manage resident personal funds deposited with the facility. Each resident receives sufficient calories and appropriate nutrients to maintain health unless the resident's clinical condition prevents it. The facility must have an agreement with at least one hospital that assures residents can be sent to a hospital when medically appropriate. If the deceased’s next-of-kin lives in the United States and there are no relatives or friends in Germany , the German authorities will contact the embassy or consulate for assistance in notifying the next-of-kin . The embassy or consulate will, in turn, contact the next-of-kin at the earliest possible time to notify them of the death and offer information about making arrangements for the disposition of the deceased’s remains. When we hear of the death of a U.S. citizen, we will endeavor to reach the deceased’s next-of-kin as quickly as possible.
